Welcome to DREXIFY. These Terms of Service ("Terms") govern your access to and use of the services provided by Drexify Systems LLC ("DREXIFY," "we," "us," or "our"), including our website at drexify.tech, our AI agent platform, client dashboard, and all related tools and features (collectively, the "Service").
By subscribing to or using the Service, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree, do not use the Service.
DREXIFY provides a done-for-you AI agent platform designed for local businesses. Our agents handle operational tasks on your behalf, including but not limited to:
We configure, deploy, and manage these agents on your behalf. You provide business details, preferences, and access as needed for setup. We handle the rest.
DREXIFY operates on a month-to-month subscription model. Our current plans are:
All plans are billed monthly through Stripe. There is no setup fee and no long-term contract. Your subscription renews automatically each billing cycle until you cancel.
You may cancel your subscription at any time through your Stripe billing portal or by contacting us at team@drexify.tech. Cancellations take effect at the end of the current billing period. No refunds are issued for partial months. You will retain access to the Service through the end of the period you have already paid for.
We reserve the right to adjust pricing with 30 days' written notice. Existing subscribers will be notified via email before any price change takes effect.
By using DREXIFY, you agree to the following:
We reserve the right to suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated these terms.
Your Data. You retain full ownership of all prospect data, customer data, contact lists, and business information you provide to us or that our agents collect on your behalf. This is your data, and we do not claim any ownership over it.
Our Platform. DREXIFY retains full ownership of the platform, all agent logic, workflows, prompts, code, and intellectual property that powers the Service. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your business operations during your active subscription period.
Aggregate Data. We may use anonymized, aggregated performance data (such as average open rates or delivery metrics across all clients) to improve the Service. This data will never identify you or your customers.
We take regulatory compliance seriously. All outreach emails sent through the DREXIFY platform comply with the CAN-SPAM Act, including:
All SMS messages sent through the platform comply with the Telephone Consumer Protection Act (TCPA). Messages are only sent to recipients where appropriate consent has been obtained, and every message includes opt-out instructions.
You are responsible for ensuring that any contact data you provide has been lawfully obtained and that you have the appropriate consent to contact those individuals. DREXIFY is not liable for outreach conducted using contact data that you provided in violation of applicable law.
These messaging program terms apply to end customers who receive SMS / text messages sent through the DREXIFY platform on behalf of a subscribing business. By opting in, you ("you") agree to the following:
To the maximum extent permitted by law, DREXIFY, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to lost revenue, lost profits, loss of business, or loss of data.
Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total amount you paid to DREXIFY in the three (3) months preceding the event giving rise to the claim.
The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or that any specific outcome or result will be achieved. AI-generated outputs (including outreach copy, voice responses, and follow-up sequences) are generated algorithmically and may occasionally contain errors.
Either party may terminate this agreement at any time.
Upon termination, your agents will be deactivated. Your data will remain available for export for 30 days after cancellation. After 30 days, your data will enter a deletion queue and be permanently removed within 90 days of cancellation. If you need your data, contact us within that 30-day window and we will provide it in a standard format (CSV or JSON).
The DREXIFY platform integrates with third-party services to deliver its functionality. These include, but are not limited to:
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions, policies, or reliability of third-party providers.
We may update these Terms from time to time. When we make material changes, we will notify you via email at the address associated with your account at least 15 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
We recommend reviewing these Terms periodically. The "Effective Date" at the top of this page will always reflect the date of the most recent revision.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved in the state or federal courts located in San Bernardino County, California.
Before initiating any formal proceeding, both parties agree to attempt to resolve disputes informally by contacting each other in writing and allowing 30 days for resolution.
